New York state’s highest court upheld a decision on Thursday to shut down former Mayor Michael Bloomberg’s ban on the sale of large-sized sodas, saying the initiative was an overreach of authority.
New York City’s health department barred the sale of sugary drinks larger than 16 ounces in 2012. Bloomberg had touted the department’s ban as a way to fight obesity during his tenure, but the court of appeals ruled 4-2 against it.
This decision upholds a lower court ruling that struck down the ban and will likely mean the end of the controversial proposal.
“The Board of Health engaged in law-making beyond its regulatory authority,” the majority decision read. “It is clear that the Board of Health wrote the Portion Cap Rule without benefit of legislative guidance.”
